DUTIES

AdeleD Photography undertakes to perform the Photo Session diligently, punctually and in accordance with the requirements of this Agreement. The Photo Session shall be executed by AdeleD Photography in a professional manner and in accordance with the practices and professional standards used in well-managed operations performing services similar to the Photo Session.

The Client may not take any personal photographs during the Photo Session.

PRICING

Prices are subject to change without notice and are non-negotiable. Due to the custom nature of photographic products, no refunds will be issued.

PAYMENT

The Client must make payment within 48 hours once a session date has been agreed. This will confirm the booking. Photo sessions will NOT commence if payment is outstanding.

All final, outstanding amounts must be paid in full before orders will be sent for print.

The amounts are payable into the bank account of AdeleD Photography

COPYRIGHT & REPRODUCTIONS

AdeleD Photography owns the copyright to all photographs rendered from the Photo Session and reserves the right to use any photograph in any form including but not limited to; the use in advertising, portfolio use, samples, self-promotions, entry into photographic contests or art exhibitions, editorial use, website, or for display inside or outside AdeleD Photography's Studio.

THE CLIENT'S USAGE

The Client undertakes to use the photographs solely for personal use.  Copying, scanning or reproducing photographs for commercial use is strictly prohibited. Any offenders will be prosecuted accordingly.

The Client is obliged to credit AdeleD Photography by citing the full names of photographic studio adjacent to each photograph where the image is published on social networking sites.

FAILURE TO PERFORM

Should AdeleD Photography not be able to perform the Photo Session in terms of this Agreement on the agreed date due to any cause beyond the control of AdeleD Photography; or due to illness; AdeleD Photography will use reasonable efforts to arrange another suitable date and time for the Photo Session with regards to AdeleD Photography booking schedule, failing which AdeleDphotography will refund the deposit to the Client and will not have any further obligations in terms of this Agreement.

INDEMNITY

The Client agrees to hold harmless AdeleD Photography from any claims or court proceedings that may arise out of the Client’s participation in the photo session. AdeleD Photography and the Client agree to the following conditions:

The Client shall hereby hold harmless AdeleDphotography from any and all actual or alleged claims, demands, liability, loss, and/or injury to property or persons (including any other individuals accompanying him /her), whether this is brought by individual or another legal entity, or imposed by a court of law that may arise out of any acts, omissions, negligence or misconduct of AdeleD Photography. This indemnification shall apply to and include without limitation the payment of all penalties, fines, attorneys’ fees, and related costs and any reimbursements to AdeleD Photography for all legal expenses.

CANCELLATIONS & POSTPONEMENTS

• If the photo session is cancelled within 24 hours of the appointment (date and time) the Client will forfeit his/her entire deposit.

• If the photo session is cancelled within 5 days of the appointment date (but prior to 24 hours of the booking) an admin fee of R800 will be deducted from any refund due to the Client.

• If the photo session is postponed within 5 days of the appointment date, an admin fee of R500 will be charged.

FAILURE TO APPEAR

If the Client fails to appear at the arranged date and time of the Photo Session (without prior notification to reschedule the booking), the Client will forfeit his/her entire deposit.

FINAL IMAGES

AdeleD Photography will notify the Client when final images are completed. a 'Reveal and ordering Session' will be booked at the Photographer's Studio.  All 'photo' and 'financial' decision makers are requested to attend. 

Large format orders will be finalised and delivered to your doorstep.

All images and prints may be signed by the Photographer.

Under no circumstances will AdeleD Photography give any RAW or unedited images to the Client. AdeleD Photography will select and process the best images for presentation.
